Protecting Your Jeonse or Wolse Deposit in Korea: A Foreigner's Checklist
Protect a Korean rental deposit as a foreigner: registry check, address report, 확정일자, HUG deposit guarantee, lease registration order.
Renting in Korea means handing over a large deposit (보증금). For jeonse (전세) that can be most of the property's value; for wolse (월세) it's smaller but still often 5–50 million KRW. Jeonse fraud cases have shown that a deposit is only as safe as the legal steps you take.
Under the Housing Lease Protection Act (주택임대차보호법), a tenant gets two key rights:
- Opposing power (대항력): your lease survives if the house is sold. You get it from occupying the home + registering your address. For foreigners, the address report to immigration (체류지 변경신고) or foreigner registration at that address counts as the move-in report.
- Priority repayment (우선변제권): you're repaid ahead of later creditors if the house is auctioned. You also need a fixed date (확정일자) on your lease.
The 4 protections everyone should know
- Check the property registry (등기부등본) on the Internet Registry Office (iros.go.kr). Viewing or issuing costs a small fee (typically under 1,000 KRW online; check the site).
- Report your address and get a fixed date the same day you move in.
- Consider deposit return guarantee insurance (전세보증금반환보증) from HUG (khug.or.kr). HUG states foreign tenants can apply if they meet the opposing-power and priority requirements (ARC or residence report, actual occupancy, move-in report, fixed date).
- If the landlord won't return your deposit, don't move your address out until you've secured a lease registration order (임차권등기명령) from the court.
The full guide covers the pre-contract checks, contract clauses you can copy, the move-in-day routine, HUG eligibility and timing, and the exit process if your deposit isn't returned.
The three contract types
| Type | Deposit | Monthly rent | Typical tenant |
|---|---|---|---|
| Wolse (월세) | Smaller (often a few million to tens of millions KRW) | Yes | Most foreigners, students, short stays |
| Jeonse (전세) | Very large (often a big share of the property's value) | None | Long-term residents with savings or loans |
| Banjeonse (반전세) | Medium-large | Lower monthly rent | Mix of both |
With jeonse, you pay no monthly rent; the landlord holds your deposit for the contract (usually 2 years) and returns it at the end. The risk: if the landlord cannot repay — common in so-called "jeonse fraud" (전세사기) cases — you can lose a life-changing sum.
Other costs to budget
- Broker fee (중개보수): capped by law according to the transaction value; landlord and tenant each pay their side. Ask the broker for the rate in writing before signing.
- Maintenance fee (관리비): monthly building costs; ask what it includes (internet, water, cleaning).
- Utilities (electricity, gas) usually separate.
- Short-term "one-room" and officetel listings may require key money or cleaning fees — ask upfront.
Red flags — walk away
- Deposit + mortgages close to or above market price ("깡통전세")
- Owner is a trust company, or the registry shows recent seizures
- "Pay the deposit to my account, I'm the owner's relative"
- Landlord refuses a deposit guarantee or the tax-arrears check
- New-build villas with no transaction history and an unusually low deposit
Phase 1 — Before you sign
1. Read the registry (등기부등본)
On iros.go.kr → *열람/발급* → search the address → choose Full record (전부).
- Section 갑구 (ownership): does the owner's name match the landlord's ID? Look for seizure (압류/가압류), auction start (경매개시결정) or trust (신탁) entries. A trust means the trust company, not the "landlord", may be the one who must consent.
- Section 을구 (other rights): mortgages (근저당권) and their maximum claim amounts (채권최고액).
- Rule of thumb: (senior debts + your deposit) should be comfortably below a realistic market price. Many advisers treat 70–80% as a warning line. Market prices: check the MOLIT real transaction price system (rt.molit.go.kr).
2. Check the landlord's unpaid taxes
Unpaid taxes can take priority over your deposit. Since 2023, tenants can view the landlord's unpaid national taxes at a tax office after signing and before the lease starts, for deposits above a set threshold, and can request local tax arrears information too. Ask: "임대인 미납국세 열람 신청하려고요." *(Check current conditions at nts.go.kr.)*
3. Check the agent
Use a licensed real estate agent (공인중개사). Confirm their registration on the local government or national real estate portal. Ask for their brokerage liability insurance certificate (공제증서).
4. Check HUG eligibility before committing
If you want deposit guarantee insurance, check eligibility before signing. Typical conditions include: deposit limits (HUG lists 700 million KRW in the capital area and 500 million elsewhere), a lease of at least 1 year, limits on senior debts, and no rights infringement. Eligibility also depends on the house's value ratios, which have tightened since 2023.
Phase 2 — Signing day
- [ ] Landlord's ID matches the registry owner. If an agent signs for the owner, get a power of attorney with a certificate of seal impression (위임장 + 인감증명서).
- [ ] Deposit goes only to the registered owner's account, never to the agent or a relative.
- [ ] Re-pull the registry on the balance payment day (잔금일), in the morning.
- [ ] Add the special clauses below.
- [ ] Get an English summary from the agent if you need one, but sign the Korean contract.
Special clauses (특약) you can request
Phase 3 — Move-in day (do all of it the same day)
- Move in physically.
- Report your address: to immigration (HiKorea e-application *체류지 변경신고*) or at the local community center (주민센터). The legal deadline is within 15 days, but do it day 1; protection starts the next day.
- Fixed date (확정일자): at the community center (bring the original lease and your ARC), or online via the Internet Registry Office's fixed-date service. There's a small fee (about 600 KRW at the counter; check locally).
- Lease report (전월세 신고): in many areas, leases above certain amounts must be reported within 30 days. Reporting also gives you a fixed date automatically.
- Apply for HUG guarantee (if eligible): HUG says to apply before half of the lease period has passed, counted from the later of balance payment and move-in report. Premium rates depend on the deposit and house type; check the HUG site or app.
Phrases at the community center
- "확정일자 받으러 왔어요. 계약서 원본이랑 외국인등록증 가져왔어요." *(I'm here for a fixed date. I brought the original lease and my ARC.)*
- "전월세 신고도 같이 할게요." *(I'll also do the lease report.)*
Phase 4 — During the lease
- Keep paying rent to the same owner's account. Keep transfer records.
- If the landlord sells, the new owner takes over the lease obligations (you have opposing power).
- Lease renewal right (계약갱신요구권): under the Housing Lease Protection Act, you can request one renewal (2 more years), with rent increases capped at 5%. Request it 6 to 2 months before the end.
Phase 5 — Moving out
- Notice: tell the landlord in writing (text or KakaoTalk with a record) at least 2 months before the end if you won't renew. Under implied renewal, give 3 months' notice.
- Inspection: take dated photos and video at move-in and move-out.
- Deposit not returned on the end date?
- Apply to court for a lease registration order (임차권등기명령). It keeps your priority even after you move out. Apply at the court covering the house, or online via the electronic litigation site.
- Only move your registered address after the order is registered in the registry.
- If you have HUG guarantee, file a claim per HUG's procedure.
- Free help: Housing Lease Dispute Mediation Committee (주택임대차분쟁조정위원회), Korea Legal Aid Corporation (132), and city jeonse fraud support centers.
Where to search
Apps like Zigbang (직방) and Dabang (다방) and portal real-estate maps are used by Koreans; brokers near universities and foreigner-friendly agencies help with English. Always visit in person and meet the actual landlord (or verify the agent's authority) before paying anything.
Getting your deposit back
- Tell the landlord at least 2 months before the contract ends (the Act's notice window) whether you will renew or leave; send it by text/KakaoTalk so you have a record.
- If you must leave Korea before the money is returned, apply for lease registration (임차권등기명령) at court before moving out — this keeps your priority after you leave the address.
- Take date-stamped photos at move-in and move-out to avoid deduction disputes.
Help
- Seoul and other cities run jeonse fraud / housing support centres — counselling is free.
- Korea Legal Aid Corporation: 132.
- Immigration Contact Center 1345 for address-report questions.
Common mistakes
- Moving in but registering the address weeks later.
- Getting a fixed date but no address report (or the reverse). You need both.
- Moving your address out to a new place before the deposit is returned or the lease registration order is in place.
- Trusting a screenshot of the registry from the agent instead of pulling it yourself.
